Borrow Freely is a venue – a passive tool for the distribution of others’ information.  Borrow Freely allows third-parties (“Borrower”) to request use of items and services from other third-parties (“Loaner”). 

YOUR GENERAL OBLIGATIONS

In general, you understand and agree to the following:

  1. “Your Content” is defined as any information you provide to Borrow Freely.  You agree you are solely responsible for Your Content, and Borrow Freely acts only as a passive conduit for the distribution and publication of Your Content and the content of other users.  Borrow Freely does not control the content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content.
  2. When borrowing, renting or buying you promise to
    1. Complete the transaction with Loaner by agreeing with Loaner on the preferred method of delivery and by paying all fees due for items or services;
    2. Return the item in the same or better condition as it was when received;
    3. Inform Loaner of any problem encountered with regard to use of the item or service;
    4. Accept the terms of the transaction as may be established by Loaner; and
    5. Not hold the Loaner responsible for any claim or demand arising out of use of the item or service.
  3. When listing items and services you agree you are legally able to loan, gift, rent or sell the item or service you list, and you promise to
    1. List only items and services known to you to be in good and safe working condition;
    2. Provide an honest description of the item or service and a complete list of terms required of Borrower to use said item or service;
    3. Abide fully by the Inappropriate Conduct and Use Policy, which you can review at any time at http://www.borrowfreely.com/terms_of_use/inappropriate.aspx; and
    4. Maintain Your Content, and correct or remove immediately any portion of Your Content that becomes known to you to be inaccurate, untrue, incomplete or misrepresentative.
  4. When loaning, gifting, renting or selling items and services you agree you are legally able to loan, gift, rent or sell the item or service, and you promise to
    1. Complete the transaction, unless there is an exceptional circumstance such as you cannot authenticate Borrower’s identity;
    2. Inform Borrower prior to the transaction of all terms and conditions associated with or required for use of the item or service;
    3. Inform Borrower of any suggestions, considerations, caveats or concerns for use of the item or service; and
    4. Not to hold Borrower responsible for any claim or demand arising out of use of the item or service.
  5. Borrow Freely has the right and privilege to provide the Service in accordance with its Mission, Vision, Values and Corporate Purpose statements.  You acknowledge Borrow Freely may establish practices and limits concerning use of the Service, as Borrow Freely deems most applicable to its Mission, Vision, Values and Corporate Purpose statements.  You can review the most current corporate statements at http://www.borrowfreely.com/basics/about.aspx.
  6. Borrow Freely has the right to remove Content that violates the TOS or is otherwise objectionable.  You agree you must evaluate and bear all risks associated with the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content.
  7. You agree not to hold Borrow Freely responsible for any claim or demand arising out of your use of the Service or Site, your connection to the Service, your violation of the TOS, or your violation of any rights of another.

  9. You are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction.
